For jobsites with fewer than five employees, one single-user, all-gender toilet facility can be sufficient under the regulation.

Just as importantly, restroom facilities must be kept clean, maintained in good working order, provide privacy, and remain stocked with toilet paper. Federal OSHA also establishes construction sanitation requirements, although California employers should pay particular attention to applicable Cal/OSHA regulations.
